Création et fonctionnement d’un parti politique La création et le fonctionnement d’un parti politique en RDC sont assujettis aux dispositions de la constitution et de la loi cadre n° 04/002 du 15 mars 2004. a. Principes directeurs auxquels les politiques sont astreints Les partis politiques sont astreints aux principes directeurs ci-après : Le respect de la constitution Le respect du caractère national Le respect du principe de l’alternance au pouvoir Consolidation de l’unité nationale Préservation de la souveraineté de l’Etat congolais Le respect du caractère républicain. N.B. : la loi interdit au parti politique tout caractère militaire, paramilitaire. b) Conditions de fonctionnement 1. Conditions de fond Liées au fondateur : toute personne fondatrice d’un parti politique doit : Etre de nationalité congolaise Avoir l’âge de 25 ans au moins Jouir des droits civils Jouir de bonne vie et mœurs N’est jamais été condamné Etre au moins gradué. 2. Conditions liées au statut Le siège du parti politique doit être établi en RDC Le projet de société du parti Avoir différentes catégories des membres Droits et obligations des membres.
